Restitution & Diversion Program (RAD)

The Restitution & Diversion Program (RAD) was established under Oklahoma law to assist victims of property crimes with the collection of restitution and divert such crimes from the criminal court system when it is deemed appropriate. The primary goal of this program is to recover loss for victims in a timely manner.
The property crime covered by the District 4- RAD Program is Defrauding an Innkeeper, which includes:
- Unpaid rent, property vacated
- Rent paid with a bad check
In RAD, we pursue contact with the offender through letters and phone calls. Upon initial contact we establish a deadline for payment in full or a payment plan with the offender for the payment of restitution. A failed agreement with RAD, could result in prosecution in District Court. We monitor payment deadlines, and we forward payments to victims as they are received in our offices. We file criminal charges and issue an arrest warrant for the offender in the event the prosecution is authorized by the District Attorney or Assistant DA.
What we need from Landlords
- Copy of a signed, dated rental or lease agreement
- Copy of the offender’s rental or credit application
- Any identification obtained at the time of rental/lease, such as copy of photo identification
- Ledger or payment history indicating dates of payments owed and of those made (history of last 6 months is preferred)
- Whether you’ve filed civil proceedings against the offender involving claimed loss
- Actual check(s) or legal copy of check(s) in the event a bad check was given for rental fees and proof of any bank charges you’ve incurred as a result
Once you submit a complaint to RAD, do NOT accept payment from the offender. The offender must be directed to contact the District Attorney and make payment through our office. Restitution to victims is disbursed monthly, on the last working day of each month. It is disbursed as it is received; therefore, if the offender sends payment in full, we will send full restitution to you in lump sum. If the offender pays in installments, we will send it to you as scheduled payments are received. The RAD program is a free service to victims.

Instructions to Offenders:
If you have received a letter or phone call from the District Attorney RAD division, please contact the office immediately. Failure to make contact could result in a criminal charge and warrant for your arrest.
Upon contact with our office, we will discuss payment options. If payment in full is not possible, a payment plan can be arranged. To be eligible for a payment plan, you must appear in person with a photo ID at our office. Once the payment plan has been established you can mail your monthly payments to the office or make payment online.
Payments should be made payable to DA RAD and be made in the form of a money order, cashier’s check, or debit or credit card. NO CASH OR PERSONAL CHECKS ARE ACCEPTED. Credit/Debit card payments can be made online with County pay location code or by telephone at 1-888-604-7888. Money orders and cashier’s checks can be mailed or delivered to the office in person.
Failure to comply with your payment plan, including late payments, could result in a criminal charge and warrant for your arrest.
